IDENTIFYING AND INVOLVING KEY MEMBERS Recently the United Kingdom enacted a comprehensive piece of document called ââ¬Å" The Construction (Design and Management ) Regulationâ⬠or in short CDM Reg, which came into force on March 31, 1995 ( Williams, 1995 ). This Regulation provides a concrete framework for the whole construction industry in Europe and it rightfully identifies and places special duties on few key personnel. Similarly, in the Malaysian context, it is important to identify and assign duties to the following key people. The Client or the Developer The starting point for the construction projects is the client, who may include property developers, government agencies or industrial companies. As they are financing the construction project, they have the discretion to exercise considerable control over the projects from inception to completion. They should be responsible for: * Appointing competent personnel to ensure that the project is completed according to the plan, cost, time and quality; * Ensuring that there are sufficient resources, including adequate time for completion; * Drafting a safety Plan with stipulated dates, so that safety issues are systematically carried out. A safety Plan is putting down in writing the various items and procedures to be undertaken; * Communicating information to the relevant authorities about foreseeable risks. For example, if the client is aware that pipes and electrical cables are running through the site, information must be communicated to the Planning Supervisor; * Ensuring that a safety file is prepared and easily available for future construction work. This will prevent the client from ââ¬Å" reinventing the wheelâ⬠,or redoing the various procedures in future. Planing Supervisor As identified earlier, communication and co-ordination are vital issues in the construction industry. The appointment of the planing Supervisor is mainly to assign a person with the overall responsibility of co-ordinating and communicating safety and health issues. The responsibilities include: * preparing and monitoring the Safety and Health Plan, taking into consideration the stipulated dates; * advising the client on the satisfactory allocation of resources; * preparing and monitoring the safety and health file. Designer The function of the designer is to sure that proper consideration is given to safety and health of the project from conception. His responsibilities include: * Introducing methods for eliminating or reducing risks. Priority should be given to incorporate control measures at the source of the problem because it will protect every subsequent employee. For example, access/egress and lighting should be constructed at the design stage and not as an afterthought; * Conveying messages mainly on hazards in the workplace to relevant people at an early stage instead of the employees to find it out for themselves the hard way. Where risk cannot be avoided, information on the risk must be provided to the Planning Supervisor for inclusion in the Safety and Health Plan. Principal Contractor Basically the principal Contractor and other contractors must ensure that the theme of co-ordination on safety and health is carried out. The main requirements are: * Ensuring that only authorized persons gain access to the site; * Providing information, training and supervision to employees and self-Department of Occupational Safety and Health; * Carrying out the Safety Plan prepared by the Planning Supervisor. Without enacting laws and enforcing it, employing the above key personnel may not be practical in Malaysia. However, its should be bone in mind that it is sufficient to assign the mentioned responsibilities to key personnel because without it no one will take the initiative or be accountable for occupational safety and health. B. EFFECTIVE COMMUNICATION In the context of todayââ¬â¢s work relationship, there is overwhelming evidence that one-way communication is factory. Management needs to initiate and maintain a dialogue and not a monologue with people involves information coming into the organization. Looking at each one separately. In-coming: In any organization, there should be arrangements to keep abreast of the information that is relevant to the industry. The governmentââ¬â¢s recent proficiency test proposal for engineers, surveyors, architects, is aimed to achieve a high level of efficiency, productivity, quality and safety. The construction industry must keep abreast with the legal developments and technical improvements because it cannot afford to develop through a trial and error method. Out-going: Procedures to inform the authorities on issues such as reporting accidents to DOSH, providing information to the press, emergency service, local resides etc. Within the organization: This is very important and is mainly divided into two main areas: a) Visible communication; b) Written communication. Visible communication include: * Behavior of managers and supervisors. Management must be seen to be committed and interested in safety because the attitude of the workers is always the supervisors. For example, if managers do not wear safety helmets at the construction site, workers would not do so either. If managers are late or do not turn up for safety meetings, the employees would do the same; * Regular safety tours; Risk assessment or audits; * Provision for feedback from anyone interested in OSH; * A senior manager should chair meetings; * Provide training to employees. This is a visible indication that management cares for the staff. Written communication include: * A written Safety Policy which is easily available to anyone; * Performance standards and safety procedure standards that are written down; * Records of risk assessment/audi ts, technical inspections, etc. In addition, each contractor must introduce a communication channel between his subordinate and his supervisor. For example, the subordinate contractor should report matters to his contractor and also be informed and be responsible for issues pertaining to subcontractors. To achieve this the contractor must conduct frequent meetings, site audits, inspections, training, etc. Without any doubt an effective and efficient working Safety Committee is vital to the communication channel is open. C. MANAGING CONTRACTORS Having introduced the construction industry and its key members, the next important issue is managing contractor. Acquiring the service of competent contractor with a good safety record is fundamental to the success of a construction industry. Let us now look at the meaning of a contractor. Legally, anyone involved in any work activity for reward is a contractor. The contractor is therefore contracted to do something for another party and in consideration for what is done, receives a payment. The contractors are subjected to the same guiding rule of OSH Act 1994 and their duties are covered in Part IV of OSH Act, under the heading ââ¬Å"General duties of employee and self-employed personââ¬â¢Ã¢â¬â¢. Apart from the general duties under OSH Act 1994, there are also specific statutory duties under the Factories and Machinery Act 1967, i. e. in relation to Building Operation and Works of Engineering Construction, Noise, Mineral dusts, Lead, Welfare, etc. Though there are basic legal requirement for contractors, the client or any managing contractor will encounter problems in the contraction site if additional safety standards are not specified in the contract document at the time of tendering. There is the ââ¬Å"escape clauseâ⬠for new contractors if standards are introduced at a later stage, because any fresh standard would subsequently affect the price and duration of the existing contract. Therefore, any specific prerequisites of the project of the need for additional manpower must be taken into consideration when preparing and presenting the tender. All occupational safety and health facilities should be identified, quantified, costed and must be included in the contract. Such procedures should be carried out by everyone involved in the construction industry, whether it is the main contractor, sub-contractor or a self employed person. Such meticulous preparation will ensure that occupational safety and health is incorporated from the design stage and ensues throughout the project rather than just adding it, on a piecemeal basic, at a later stage. In addition to setting standards for contractors, they should also be thoroughly vetted before being selected. Examples of a check-list that will help to screen contractors are available. D. IDENTIFYING RISKS AND QUALIFYING HAZARDS The old maxim of ââ¬Å"what cannot be measured, cannot be managedâ⬠is very appropriate in this context. Risk assessment is a proactive measuring tool, based on the principle of fact finding rather than fault finding. The fact finding process of risk assessment would mean that the necessary corrective actions can be taken to improve operations and conditions. Physical inspections, flow charts organizational charts, fault tress, hazard indices, hazard and operability studies (HAZOP), audits, incident recall, checklist, etc. are other tools used for identifying, quantifying and even controlling risk. In addition to quantifying processes there are also benefits in quantifying the performance of contractors. For example, a huge billboard displayed at the entrance of the contraction site based on the performance of the various contractors may encourage contractors at the bottom of the table to pay greater attention to safety and health. When Writing an Essay in the First Person, Should You Use Quotation Marks?The first rule is never to use quotation marks with the first sentence of an essay. You cannot start a sentence with a quotation. You have to start the sentence with something like 'This was my favorite passage.' If you have nothing to say, don't start your first sentence with something like that.There are a few problems with using quotation marks in an essay. The first one is that it is very hard to keep the point you are trying to make in the same paragraph with the quote. If you say 'However,' and then take out the last two or three words of the sentence, it is no longer interesting.The second problem is that you can lose the true point. Many people are writing essays on the history of America. They say things like, 'The United States Government had been founded upon the idea of equality.' Pit Bulls Manââ¬â¢s Best Friend Did you know that chihuahuaââ¬â¢s are considered the most aggressive dog breeds in the world? I know what youââ¬â¢re thinking; ââ¬Å"yeah right pit bulls are the most aggressiveâ⬠. This is a common misconception and there has been plenty of studies to prove otherwise. The most recognized of these studies is conducted by the American Temperament Test Society (ATTS). They have tested countless dogs chihuahuaââ¬â¢s are always the most aggressive, even with proper training. I know there is a very large group of people in this world that think pit bulls are dangerous and aggressive and I am here to change their minds and come up with a solution to prevent this unfair and negative stigma. Here is my solution; We can change the stigma behind pit bulls by teaching people that dogs are not born evil. It is all about how we raise our dogs. If we can teach people how to properly raise and socialize a pit bull (or any dog), we can stop the stigma. I am going to tell you a true sto ry and follow it with a statement from the ASCPA before I move into details pertaining to my solution. The story and statement will show pit bulls are not aggressive dogs. Nana Chai was getting ready to go to sleep, she just put her 7-month-old to sleep in her crib in the other room. As Nana was about to get in bed, she heard her dog, a Pitbull named Sasha scratching the back door. Nana was worried because Sasha didnââ¬â¢t usually scratch at the door, so she let her in. Sasha started barking wildly at Nana and alerted her that there was a fire. Nana started rushing to the babyââ¬â¢s room, but Sasha was already there. ââ¬Å"Nana found Sasha trying to get the baby to safety, she was pulling her by her diaper to try and save her from the fire.â⬠(Caitlin Nolan) Nana and her baby Masailah both lived and did not sustain any injuries. The reason that they were okay was because of their pit bull Sasha, the dog gave Nana enough time to be alert and ready for the fire. If Nana had believed the stigma concerning pit bulls, she may not have owned Sasha, in which case she may not have escaped the fire. This example shows that pit bulls can be caring an d protective dogs. Now, letââ¬â¢s review the statement by the American Society for the Prevention of Cruelty to Animals (ASPCA). In summary, the statement defines what a ââ¬Å"pit bull isâ⬠, it explains that they are ââ¬Å"descendant of the original English bull-baiting-dog.â⬠(ASPCA) When animal baiting was outlawed people started fighting their English bull-baiting-dogs. Eventually people started to breed them with smaller breeds such as terriers in order to make them more agile and capable of fighting. It is important to note that, the dogs people bred were meant for fighting other dogs. If the dog showed hostilities towards a human, they were generally put down and no longer breed as it could have caused future lines to be aggressive towards humans. According to the statement made by the ASPCA ââ¬Å"the reality is that dogs of many breeds can be selectively bred or trained to develop aggressive traitsâ⬠. This shows us that specific dog breeds are not just born aggressive, they need to be bred or trained or even beaten into being aggressive. Dogs are similar to humans; they each have their own personalities. They learn from their experiences and they grow and change depending on them. à Unfortunately, since pit bulls are seen as mean dogs, people often raise them to be aggressive dogs and when these poorly raised dogs attack, it fuels the stigma. Letââ¬â¢s move into how to properly raise and socialize a dog and the outcome of doing so. It is important to know that socialization and proper training is effective for any dog and not just pit bulls. If any breed of dog is improperly raised it has the same risk to turn aggressive or to ââ¬Å"act outâ⬠at times. Socialization means to socialize (interact) the dog with other dogs and people. According to a recent study (2015) on socialization practices on adult behavior ââ¬Å"Dogs that are appropriately socialized as puppies are less likely to exhibit behavioral problems as adults, including aggression and fearfulnessâ⬠(Howell et al.). This shows the importance of starting proper socialization at a young age. It is much harder to take an adult dog and socialize and train him, especially if they are already aggressive. I know your probably wondering, well how do we ââ¬Å"properly socializeâ⬠a dog. There is a plethora of ways to do this, but here is some of the most effective. First you want to expose the dog to people and other animals from an early age . The more they get to be around and play with people and animals the more they get used it. It is imperative to allow your dog to touch you and other animals. This will help them see that they do not need to fear or fight people and animals. Second, you just need to be nice to the dog. Donââ¬â¢t beat the dog for every mistake it makes and be sure to reward the dog when they do good. If they go poddy inside, scold them and put them outside. If they listen to a command you give, reward them. As the dog grows older and is no longer a puppy you still need to continue with proper socialization and training. You wonââ¬â¢t need to do it as frequently, but you canââ¬â¢t just abandon it when they are no longer a puppy. A study conducted by Dept. of Veterinary Medicine, Cambridge England at the Pfizer breeding colony in the United Kingdom tested socialization and training techniques and outcomes in ââ¬Å"teenage dogsâ⬠(1-3 Years). The study was conducted for one year and they had separate control groups which consisted of, properly raised and improperly raised dogs. It was found that ââ¬Å"dogs given increased human socialization were more approachable then dogs from the other groupsâ⬠(Hubrecht). After one year of study the dogs from both groups has improvement from where they started. The dogs that were in the group that had already been trained did have much better results. As I have said, all dog breeds are equal when it comes to aggression risks and personalities. The last research study that I will bring up was conducted by the School of Veterinary Science, University of Bristol, United Kingdom. This study tested multiple breeds including pit bulls and it concludedà ââ¬Å"it would be inappropriate to make assumptions about an individualââ¬â¢s animalââ¬â¢s risk of aggression based on characteristics such as breedâ⬠(Casey). I have showed you how properly raising a dog has a huge outcome on a dog and that no matter the breed. They all need to be raised the same to be none aggressive dogs. If more people were to realize that a dogââ¬â¢s attitude is depending on how the owner raised the dog, we can stop the stigma of pit bulls are aggressive dogs. I previously said that pit bulls are raised to be aggressive, because people think they naturally are. If we can spread this knowledge and information, as well as teach people how to raise a d og, we can defeat the stigma that pit bulls are naturally aggressive. Similar characters whom the kid meets are Captain White and later Glanton and his gang with whom he goes on scalphunting rampages (Greenwood 50). McCarthy weaves together history and fiction, with some of his characters being real people who had appeared in historical accounts of travels with the scalp hunter Glanton. They include ââ¬Å"the kidââ¬â¢sâ⬠fellow scalp hunters, the expriest Tobin, Marcus Webster, David Brown and John Jackson. The author ââ¬Å"builds certain major fictional events in the narrative out of pieces of minor historical artifacts and strings certain major historical events together with his fictionâ⬠(Moos 25). In 1849 when the kid reaches Fredonia, in present-day Texas which had been the site of a land battle between the Mexican government and the founders of a separatist republic who had grabbed the land. Thus, Texas had been annexed by the United States government in 1845, and by 1849, the region was an area of conflict between Mexican governmen, native Americans, U.S. government and Texas (Greenwood 50).
